Please read these Terms and Conditions ("Terms") carefully before using the website located at theequestriancollective.co (the "Site") or the The Equestrian Collective mobile application (the "App"), collectively referred to as the "Services."

These Terms constitute a legally binding agreement between you ("Member" or "you") and The Equestrian Collective ("we," "us," or "our"). By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

 

1. Eligibility

The Equestrian Collective is intended exclusively for women aged 18 years or older. By creating an account or accessing our Services, you represent and warrant that:

      You are at least 18 years of age

      You have the legal capacity to enter into a binding agreement

      You are not prohibited from using our Services under any applicable law

      All registration information you provide is accurate, current, and complete

We reserve the right to terminate accounts or deny access to any user who does not meet these eligibility requirements.

 

2. Account Registration

Creating Your Account

To access membership features, you must create an account through the Apple App Store or Google Play Store. You agree to provide accurate information during registration and to keep your account details up to date.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

One Account Per Person

Each membership is for a single individual only. You may not share your account credentials with others or allow any other person to access our community or content using your account. Account sharing may result in immediate termination without refund.

 

3. Membership and Subscription

Membership Tiers

The Equestrian Collective currently offers two membership levels:

      Smarties Level: $9.99 per month, providing access to the core community and resource library

      Leg Up Level: $39.99 per month, providing full coaching support, live sessions, and all Smarties benefits

Features and pricing are subject to change. We will provide reasonable advance notice of any material changes to your current plan.

Billing and Renewal

Memberships are billed on a monthly basis and automatically renew until cancelled. Billing is managed entirely through the Apple App Store or Google Play Store, and your subscription will be charged to your payment method on file with those platforms at the end of each billing period. We do not process payment directly and do not store your payment information.

By subscribing, you authorize the applicable app store to charge your payment method the applicable monthly fee on a recurring basis until you cancel.

Free Trial

From time to time, we may offer a free trial period for new members. If a free trial is offered, you will be charged the applicable membership fee at the end of the trial period unless you cancel before the trial expires. Trial eligibility is limited to one per person and may not be combined with other promotions.

Cancellation

You may cancel your membership at any time through the Apple App Store or Google Play Store subscription management settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to your membership benefits through the end of the period for which you have already been charged. We do not offer pro-rated refunds for partial months.

Refunds

All subscription fees are non-refundable except as required by applicable law or as expressly offered by us in writing. If you believe you have been charged in error, please contact us within 30 days of the charge at the contact address in Section 14.

Price Changes

We reserve the right to change membership pricing at any time. If we increase the price of your current membership tier, we will notify you at least 30 days in advance. Your continued use of the Services after the price change takes effect constitutes your acceptance of the new price.

 

4. Community Standards and Acceptable Use

Our Community Values

The Equestrian Collective is a private, women-only space built on respect, encouragement, and shared love of horses. All members are expected to contribute to a supportive and uplifting environment.

Prohibited Conduct

By using our Services, you agree that you will NOT:

      Harass, bully, threaten, intimidate, or demean any other member or staff

      Post or share content that is abusive, discriminatory, hateful, sexually explicit, or otherwise offensive

      Share another member's personal information without their explicit consent

      Impersonate any person or misrepresent your identity or affiliation

      Spam the community with repetitive, irrelevant, or promotional content

      Solicit other members for commercial purposes, sales, or multi-level marketing schemes

      Share, reproduce, or distribute any content from our community or platform without written permission

      Attempt to gain unauthorized access to any part of the Services or another member's account

      Use the Services for any unlawful purpose or in violation of any applicable law

      Post content that infringes the intellectual property rights of any third party

Enforcement

We reserve the right to remove any content and to suspend or permanently terminate the account of any member who violates these community standards, at our sole discretion and without prior notice. Termination for cause does not entitle you to a refund.

 

5. Coaching Content and Wellness Disclaimer

Not Professional Medical or Therapeutic Advice

The content provided by The Equestrian Collective -- including coaching sessions, community discussions, written materials, quizzes, and all other content -- is for informational, educational, and personal development purposes only. It does not constitute medical, psychological, therapeutic, veterinary, or professional advice of any kind.

Jenna and The Equestrian Collective team are life coaches, not licensed therapists, medical professionals, or veterinarians. Nothing in our Services is intended to diagnose, treat, cure, or prevent any physical or mental health condition in you or your horse.

Your Responsibility

You are solely responsible for your own physical, mental, and emotional wellbeing, as well as the care and welfare of your horses and animals. You should consult qualified professionals (including physicians, mental health practitioners, and veterinarians) before making changes to your health, exercise, nutrition, or animal care routines based on anything you encounter in our Services.

By using our Services, you acknowledge and accept these limitations and agree that The Equestrian Collective shall not be liable for any decisions you make in reliance on our content.

 

6. Intellectual Property

Our Content

All content available through our Services -- including but not limited to text, graphics, logos, images, audio, video, quiz materials, coaching frameworks, the micro-step method, course materials, and community resources -- is owned by or licensed to The Equestrian Collective and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our content solely for your own personal, non-commercial use as a member. This license does not include the right to reproduce, distribute, publicly perform, publicly display, sublicense, modify, or create derivative works from our content without our prior written consent.

Your Content

By posting, uploading, or otherwise submitting content to our community platform ("User Content"), you grant The Equestrian Collective a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with the operation and promotion of our Services.

You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate the rights of any third party.

Feedback

If you provide us with suggestions, ideas, or feedback about our Services, you grant us the right to use that feedback without restriction or compensation to you.

 

7. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy. You can find the Privacy Policy at theequestriancollective.co.

 

8. Third-Party Services and Links

Our Services integrate with and link to third-party platforms, including the Apple App Store, Google Play Store, and payment processors. These third parties have their own terms and privacy policies, and your use of those services is governed by their terms, not ours.

We are not responsible for the content, practices, or policies of any third-party services. The inclusion of a link or integration does not imply our endorsement of that service.

 

9. Disclaimers and Limitation of Liability

Services Provided "As Is"

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, The Equestrian Collective, its founders, coaches, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use our Services.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of the Services exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless The Equestrian Collective and its founders, coaches, employees, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

 

10. Modifications to the Services

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. This includes changes to features, content, pricing, and community structure. We will make reasonable efforts to notify members of material changes in advance. Your continued use of the Services following any modification constitutes your acceptance of the updated Services.

 

11. Termination

Termination by You

You may cancel your membership and terminate your account at any time through the App Store or Google Play subscription settings. Termination does not entitle you to a refund for any remaining portion of your current billing period.

Termination by Us

We may suspend or permanently terminate your account at any time, with or without notice, for any of the following reasons:

      Violation of these Terms or our Community Standards

      Conduct that we believe is harmful to other members, our team, or our community

      Non-payment of subscription fees

      Any other reason at our sole discretion

Upon termination, your right to access the Services ceases immediately. Any provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

 

12. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which The Equestrian Collective is registered, without regard to conflict of law principles.

Informal Resolution

Before initiating any formal dispute process, you agree to contact us first and attempt to resolve the dispute informally. Please send a written description of your concern to the contact address in Section 14. We will attempt to respond and resolve the issue within 30 days.

Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration, not in a class action or representative proceeding. You waive your right to a jury trial and to participate in a class action lawsuit with respect to any such dispute.

Exceptions

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims for amounts under $10,000 USD may be brought in small claims court in lieu of arbitration.

 

13. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Equestrian Collective with respect to the Services and supersede all prior agreements, representations, and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We will not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or other force majeure events.
